These terms (hereinafter "the Terms") describe conditions of participation in the contest "Fantasy Club World Cup" (hereinafter "the Contest").
The Contest is organised by WELL TOMEK, having its registered seat in Sieradz (Poland), ul. Władysława Łokietka 15/25, REGON 364381282, NIP (tax identification number) 8272274483 (hereinafter “the Organiser”).
The Contest will be operated through a website (hereinafter “the Website”) available at http://fantasytopfootball.com between 7th December 2017 and 17th December 2017.
The Contest will be organised both on the territory of the Republic of Poland and abroad on the terms set out herein.
The Organiser hereby represents that the Contest is not a game of chance, lottery, mutual bet, promotional lottery or any other chance-dependent game for the purposes of the act on gambling of 19th November 2009.
The Organiser is solely responsible for the running of the Contest, the provision of the Website through which the Contest will be available, the determination of the Contest winners (hereinafter "the Winners") as well as the distribution of the prizes (hereinafter "the Prizes") to the Contest Winners.
The Contest is available to individuals having full capacity to contract (hereinafter “the Contestant”) subject to the next sentence. A minor over 13 years of age may participate in the Contest subject to a written consent to participation in the Contest from his/her parent or legal guardian, who will collect the prize on his/her behalf. In the event of a win, a minor Contestant must submit such consent to the Organiser. Failure to fulfil the above obligation will be deemed as waiver of participation in the Contest and of the right to any Prizes.
Upon registration with the Contest will be required to:
insert the Contestant’s e-mail address, password and confirmation of given password,
insert the Contestant’s name of a manager, name of the supported club and country,
submit that the Contestant acknowledges that he/she is familiar with the Contest Terms and accepts the same.
Upon registration with the Contest, the Contestant may give voluntary consent to his/her personal data provided in the registration form being processed for the purposes of running the Contest and awarding of the Prizes. The provision such data is voluntary. Such consent may be withdrawn at any time.
Upon registration with the Contest, the Contestant may give voluntary consent to his/her personal data provided in the registration form being processed for the purposes of providing commercial information from The Organizer or his partners. The provision such data is voluntary. Such consent may be withdrawn at any time.
In the Contest it is forbidden to use vulgar names or descriptions.
The Organiser's employees as well as their family members may participate in the Contest. However, they will not be eligible for the prizes and their taking prize-winning places will have no impact upon any other users' rights to claim prizes. Where a prize-winning place is taken by a person not eligible for the prizes, the prize for such place will be awarded to the person who has taken the next place.
The Contestant may set up a maximum of 1 team in the Contest.
OBJECT OF THE CONTEST
The object of the Contest is to select a virtual football teams and manage them on the terms set out below in order to obtain a maximum score. The Contest is based on selected football matches of 2017 FIFA Club World Cup (hereinafter “the Competition”). Points are awarded per actual achievements of the players selected by the Contestant during the Competition.
The Contest consists of 3 gameweeks (hereinafter “the Gameweeks”).
Choice of the matches of the Competition is being made by the Organizer and is visible at the Matches page.
REGISTERING A TEAM
The Contestant may join the Contest at any time of its duration.
Taking part in the Contest is free of charge. The Contest may be joined by submitting a duly completed electronic form available on the Website containing:
the name of the team (hereinafter “the Team”), to be visible to all Contestants;
names and surnames of 15 football players, selected from the transfer list, to make up the squad (hereinafter “the Squad”) for a given Gameweek;
names and surnames of 11 players of the Squad signed up for a given Gameweek, on the terms set out in section V of these Terms;
name one of the players selected and signed up for a given Gameweek as a captain and one as vice-captain of the Squad.
In order to enable the Contestants to set up Squads, the Organiser will publish a transfer list on the Website, i.e. a list of the football players available to the Contestants together with the conventional value of each player.
Maximum number of players in the Squad from a single Club is
Maximum value of the Squad can be
equal to the value for a specific Gameweek given at the Gameweeks page.
Overdrawing this value is not allowed.
The Contestant buys to the Squad following players: 2 goalkeepers, 5 defenders, 5 midfielders and 3 forwards.
The Contestant picks the new Squad before a deadline of each Gameweek according to the rules described above.
The Team of the Contestant has an individual Squad for each Gameweek.
Out of the 15 football players of the Squad, the Contestant selects 11 players who set up a Squad’s lineup.
Until the moment each time specified by the Organiser on the Website as a deadline for a given Gameweek, the Contestant may freely (without any penalty points) shape and change the composition of the Squad signed up for a given Gameweek as well as making transfers, i.e. “purchasing” and “selling” players of his/her Team within the specified budget and limitations.
When the Contestant has not submitted his/her Squad within the deadline specified for signing up a Squad for a given Gameweek, the Organiser will deem the Team to be signed up
with the same Squad as in a previous Gameweek (concern up to Gameweek 2 inclusive).
After Gameweek 2, the Organiser will deem the Team to be signed up as an empty one (without the Squad).
The players are awarded points based on their performance in real matches.
The number of points scored by a Team of the Contestant is equal to the total scores won by each Squad submitted for each Gameweek.
Total points scored by the Squad in a Gameweek are sum of points of the lineup players, considering all provided rules below about points of the Captain, Vice-captain and substitutes of the Squad.
Points are only scored by the players who actually played in a given match, regardless of the length of presence on the pitch. The player gets points for a clean sheet or is penalized for goals conceded only when played 60 minutes or more.
If a lineup player did not play, he is substituted by the highest priority outfield substitute who played in the Gameweek and doesn't break the formation rules.
The player scores points for:
Performace (including Extra Time):
60 minutes or more: 2 points,
less than 60 minutes: 1 point.
goalkeeper: 8 points,
defender: 6 points,
midfielder: 5 points,
forward: 4 points.
Penalty shoot-out is excluded.
Assist. Assists are awarded to the player from the goal scoring team, who makes the final pass before a goal is scored. An assist is awarded whether the pass was intentional (that it actually creates the chance) or unintentional (that the player had to dribble the ball or an inadvertent touch or shot created the chance). If an opposing player touches the ball after the final pass before a goal is scored, significantly altering the intended destination of the ball, then no assist is awarded. Should two opposing players touch the ball after the final pass before a goal is scored, then no assist is awarded. Points according to the positions:
goalkeeper: 6 points,
defender: 4 points,
midfielder: 3 points,
forward: 3 points.
Assist+. If a shot on goal of the player is saved by a goalkeeper or hits the woodwork, and a goal is scored from the rebound, then an assist+ is awarded. If a player shoots or passes the ball and forces an opposing player to put the ball in his own net, then an assist+ is awarded. Points according to the positions:
goalkeeper: 3 points,
defender: 2 points,
midfielder: 2 points,
forward: 2 points.
Clean sheet. A clean sheet is awarded for not conceding a goal whilst on the pitch and playing at least 60 minutes (excluding injury time). If a player is substituted when a goal is conceded then this loss still affects his clean sheet points. Points according to the positions:
goalkeeper: 4 points,
defender: 4 points,
midfielder: 1 point.
Earning a penalty (Penalty awarded): 2 points, regardless a player position;
Penalty save: 5 points. Shots off target are excluded. Penalty shoot-out is excluded.
The player loses points for:
Goal conceded by the club of the player. Except the first one:
goalkeeper: minus 1 point,
defender: minus 1 point.
If a player is substituted (and played at least 60 minutes) when a goal is conceded it affects his goal conceded points.
Penalty shoot-out is excluded.
Yellow card (regardless a player position) – minus 1 point.
Red card (regardless a player position) – minus 3 points. When a player is shown two yellow cards (red card as a result) then he loses 3 points.
Own goal (regardless a player position) – minus 2 points.
Penalty caused (regardless a player position) – minus 2 points.
Penalty missed (regardless a player position) – minus 2 points. Penalty shoot-out is excluded.
The points scored by the player appointed by the Contestant as the Squad Captain for a given Gameweek will be doubled. In the event that the Squad captain does not play in a Gameweek, his role is assumed by the vice-captain, whose scores are doubled accordingly. If neither the captain nor the vice-captain play in a match, the points scored by the substitutes substituting them will not be doubled.
Points are awarded based on the statistics published by the Organiser. The statistics are subject to verification and may be changed either during or after a given Gameweek. For the purposes of the Contest, the scoring published on the Website is final, subject to the right to lodge a complaint.
Overall Rank of Teams - comprises all Teams registered with the Contest and shows the sum total of the points awarded in the Contest. The Contestant whose Team has won the greatest total number of points, will become the Contest Winner.
Overall Rank of Managers - comprises all Managers registered with the Contest and shows the sum total of the points awarded in the Contest. The Contestant whose Manager has won the greatest total number of points, will become the Rank of Managers Winner. Score of the Manager in the single Gameweek is the sum of the points of 15 players of the Squad, plus points of the player whose role is being a captain (either Captain or Vice-captain, depending on Captain’s performance).
Overall Rank of Leagues - comprises all Private Leagues registered with the Contest and shows the sum total of the points awarded in the Contest. The Contestant whose League has won the greatest total number of points, will become the Rank of Leagues Winner. One Manager may own only one private league. One Team may participate in maximum of 15 private leagues.
Gameweek Rank of Teams - comprises all Teams registered with the Contest and shows the Gameweek points awarded in the Contest. The Contestant whose Team has won the greatest total number of points, will become the Gameweek Winner.
Gameweek Rank of Managers - comprises all Managers registered with the Contest and shows the Gameweek points awarded in the Contest. The Contestant whose Manager has won the greatest total number of points, will become the Managers Gameweek Winner.
Gameweek Rank of Leagues - comprises all Leagues registered with the Contest and shows the Gameweek points awarded in the Contest. The Contestant whose League has won the greatest total number of points, will become the Leagues Gameweek Winner. Score of the League in the Gameweek is the sum of Gameweek’s points of the best (looking at the Overall Rank) 10 Teams in the League that joined the league at least at the moment of the final calculation of the Gameweek.
In case of two or more Contestants have achieved equal total scores, then the order in the Ranking is determined based on the Rule of Precedence, i.e. the time the Team/Manager/League was created (the earlier time, the higher ranking).
The right of Prize win and reception is entitled to the Contestants who provided personal data, i.e. first name, last name and PayPal e-mail address.
Authorization of personal data for the needs of the contest (in accordance with the Personal Data Protection Act from 29.08.1997, Act Log from 2002, no. 101, position 926 incl. subsequent changes) is voluntary.
Specific personal data may be given only for one e-mail address (portal account).
Refusal of authorization of personal data at the moment of the beginning of Gameweek 1 is equal to the resignation to the Prizes.
The Contestant who met the requirements written above may become the Laureate and win the Prizes.
The Prizes in the Contest are in the Rank of Teams for
the best Contestant:

The Prizes in the Contest are in the Rank of Managers for
the best Contestant:
1. place: 15 EUR;
The Prizes in the Contest are in the Rank of Leagues for
the Contestant who is the owner of the best Private League:
1. place: 10 EUR;
It is allowed to the single Contestant to win more than one Prize.
The Prizes may not be replaced.
The Prizes listed above are given as a gross value.
The Prizes awarded in the Contest are taxable under the act on personal income tax of 26 July 1991 (consolidated text: Journal of Laws of 17 January 2012, item 361, hereinafter "Personal Income Tax Act"). The Organiser hereby informs that a lumpsum tax at a rate of 10% of the value of the Prize is due where the value of the Prize exceeds PLN 760. The amount of tax deducted from the Prize will be paid to the relevant Tax Office under Art. 30 (1)(2) of Personal Income Tax Act with the balance to be paid to the Winner.
It is the Organiser’s obligation to calculate, collect and pay the tax to the bank account of the relevant Tax Office.
During the Contest, the Organiser may offer additional prizes other than those set out in section VIII. The types of prizes and conditions of their award will be expressly stipulated on the Website. The offer of additional prizes will not be deemed as an amendment to these Terms.
AWARDING OF PRIZES
The Organiser must verify the personal data of the Laureates.
The Organiser will verify the Contest results and publish on the Website a list of Laureates which can contain the following data: name, surname and Team/Manager/League details, within 14 business days of the end of the Contest. Each Contestant consents, in the event of winning a Prize in the Contest, to his name and surname being published on the Website along with the information about the Prize.
Upon verification of the results in accordance with paragraphs 1 and 2 above, the Organiser will send an e-mail, within 14 business days of publishing the List of Laureates, to the Contest Laureates requesting them to confirm their personal data. The Contestant will be required to provide the answer, within 14 business days of receiving a relevant e-mail, by e-mail to the Organiser's email address from which the information on the win was sent.
The details of delivery of Prizes to the Laureates, including the manner, place and time of delivery, will be agreed upon with each Laureate, with the Prize being delivered no longer than within 30 calendar days of the date of informing the Laureate of the win.
The Contestant providing incorrect data or a change in such data precluding the Contestant to whom a Prize has been awarded from being contacted may result in such Contestant being excluded from the Contest. A Contestant must immediately inform the Organiser about any changes in his/her personal data, by e.g. sending an e-mail to the address provided by the Organiser.
In the event of failure by a Contestant to provide the data set out in paragraph 3 above within the specified deadlines, the Contestant will forfeit his/her right to the Prize.
A Laureate may not assign the right to the Prize to any third parties.
Each Contestant may lodge a complaint with the Organiser in connection with the Contest.
Complaints may be submitted in writing to the Organiser’s address: WELL TOMEK in Sieradz, ul. Władysława Łokietka 15/25, 98-200 Sieradz, Poland, providing a mailing address to which a response may be sent, or by email to: email@example.com.
A complaint must contain: name, surname and mailing address of the person making a claim, as well as a detailed specification of the grounds for the complaint and the claim itself.
Complaints may be lodged throughout the duration of the Contest and not longer than within 14 business days of the date the List of Laureates is published. The deadline for lodging a complaint will be deemed to be observed based on the date on the postal stamp, date of dispatch of a messenger parcel containing the complaint or date of registration by the server of an email containing the complaint.
The Organiser has 7 business days of receipt of a complaint to process it. The Organiser will respond, as soon as the compliant has been handled, to the Contestant who lodged a complaint in writing by registered mail to the mailing address provided by the Contestant and additionally by email. Complaints made by email will be responded by email.
A Contestant whose complaint has not been admitted may enforce any claims by way of litigation before a relevant court of law.

The Organiser acts as the administrator of the data provided by the Contestants.
The personal data are provided voluntarily; however, their provision is prerequisite to competition for the Prizes. The Organiser will process the following personal data of the Contestants: name and surname, e-mail address, PayPal e-mail address on delivery of Prizes. The Contestants’ personal details will only be processed for the purposes of correctly running the Contest, including the delivery and settlement of Prizes and contact with the Contestants. A Contestant has a right to access and amend his/her personal data, and to request that such data no longer be processed.
A Contestant may amend or remove his/her personal data in the profile settings on the Website or the Organiser at the Contestant’s request submitted to the address provided in section XII of these Terms or to the email address provided by the Organiser. In the event of a request in writing, the Contestant must provide a mailing address.
A request must specify the exact data to be removed. The Contestant will be informed of the data being removed by email or mailing address provided by the Contestant.
The Contestants’ data processing term, for the Contest purposes, begins at the time the data are provided by the Contestants until the lapse of the deadline for lodging and handling the complaints by the Organiser as set out in these Terms.
Upon the end of the Contest, the Organiser will automatically save the created accounts for the purposes of future Contest editions unless the Contestant decides otherwise.
In the event of a match being rescheduled, repeated, cancelled, or in any other situations not provided for in these Terms, the decision on how points are to be awarded and which standings will be affected will be made by the Organiser.
The Organiser hereby informs that any events that are not part of standard operation of the Contest which cause or may cause disruptions to the running of the Contest may affect its operation. In such cases, the Organiser will decide whether or not to continue with the Contest.
A Contestant may resign from the Contest by sending a resignation in writing to the Organiser’s address, as well as by email to the address: email@example.com. A resignation by a Laureate entails a waiver of the right to the Prize awarded.
The Organiser has the right to amend these Terms in the event that, e.g., it is necessary to provide for changes in the law, make precise any provisions arising doubts of Contestants or in order to better protect Contestants, insofar as it will not adversely affect the terms of participation in the Contest or the basic rules of the Contest. Any amendments to these Terms will not affect any rights already acquired by the Contestants. The information on any amendments to these Terms will be published on the Website or sent by email to all Contestants who joined the Contest prior to such amendments and agreed to their data being processed.
Contestants will be notified of any amendments to these Terms in advance so as to enable them to familiarise themselves with such amendments and, if applicable, to withdraw from the Contest. Should a Contestant not accept any of the amendments to these Terms, he/she may withdraw from the Contest without any adverse consequences.
In matters not regulated herein, the relevant provisions of the law will apply.
These Terms will be binding from 07.12.2017 until the end of the Contest, subject to its provisions – to a relevant extent – remaining in force for the purposes of the complaint procedure.
These Terms do not affect the rights of the Contestants as Consumers under the applicable regulations, which take precedence over these Terms.
